Welcome to OUTERO.

OUTERO is an online platform that connects people who want to rent out sports, outdoor and other equipment with people who want to use that equipment for a specific period of time.

Our goal is to make sharing equipment simple, transparent and safe for everyone.

By using OUTERO, you agree to these Terms and Conditions.

1. What OUTERO is

OUTERO provides a platform where users can:

  • list equipment for rent;
  • search for and discover available equipment;
  • send and accept rental requests;
  • make payments through the platform;
  • communicate about equipment collection and return.

OUTERO does not own the equipment listed on the platform and is generally not a party to the rental agreement between the owner and the renter.

The contractual relationship for a specific rental is between the user providing the equipment and the user renting it.

OUTERO provides the platform and helps facilitate and administer the rental process.

2. User accounts

Certain OUTERO features may require you to create an account.

You agree to:

  • provide accurate and up-to-date information;
  • keep your login details secure;
  • not use another person's account;
  • not publish misleading or false information;
  • not use the platform for unlawful purposes.

You are responsible for activity carried out through your account.

3. Equipment listings

The owner is responsible for the content of their listing.

A listing should accurately describe:

  • the type and model of the equipment;
  • its condition;
  • included accessories;
  • the rental price;
  • availability;
  • any security deposit;
  • any important restrictions or conditions of use.

Photos and descriptions must represent the equipment honestly and must not create a misleading impression of its condition.

OUTERO may remove or hide a listing that violates these Terms or contains inappropriate, unlawful or misleading content.

4. Bookings

The renter selects the equipment and requested rental period and submits a booking request.

A booking becomes confirmed once the owner accepts the request and any required payment has been successfully completed.

Once a booking is confirmed, both parties are expected to fulfil their agreed obligations.

The owner must provide the equipment in the condition described in the listing, and the renter must use it responsibly and for its intended purpose.

5. Payments

Rental payments are processed through the payment infrastructure used by OUTERO.

The amount payable by the renter is shown before the booking is confirmed.

Depending on the listing, a security deposit may also be required.

The deposit is intended to provide security for the renter's obligations and may be used in cases involving verified damage, missing parts or other breaches of the rental terms.

Where there is no valid reason to retain the deposit, it will be released after the rental has ended and the equipment has been confirmed to have been returned in the agreed condition.

6. Cancellations and refunds

Cancellation and refund conditions may depend on the specific booking and on when the cancellation is made.

The applicable conditions are shown to the user before the booking is confirmed.

Where a booking is cancelled under conditions that provide for a refund, the relevant amount will be returned using the original payment method or another applicable method.

If an owner is unable to provide equipment that has been booked, the renter is entitled to a refund for the service that was not provided.

Nothing in these Terms limits any consumer rights that cannot legally be excluded or restricted under applicable law.

7. Collection and return of equipment

The owner and renter are responsible for agreeing on the time, place and method of collecting and returning the equipment.

When collecting the equipment, the renter should inspect its condition and notify the owner of any visible issues that were not described in the listing.

The renter must:

  • use the equipment for its intended purpose;
  • follow the manufacturer's instructions;
  • not give the equipment to third parties without permission;
  • take reasonable care of it;
  • return it within the agreed period.

When equipment is returned, the owner should inspect it within a reasonable period.

8. Damage, loss or missing parts

The renter is responsible for damage, loss or missing parts caused during the rental period where these result from misuse, negligence or a breach of the agreed rental conditions.

Normal wear and tear resulting from ordinary use is not considered damage for which the renter should be charged.

If a dispute arises regarding the condition of the equipment, OUTERO may request information, photographs, documents or other evidence from either party.

9. Disputes and OUTERO's assistance

We understand that trust matters when you share your personal equipment with another person.

That's why, when something goes wrong, OUTERO does not simply leave users to resolve the issue on their own.

If a dispute arises regarding payment, equipment condition, a deposit, damage, missing parts or another breach of the rental terms, users can contact OUTERO.

We will review the information and evidence provided by both parties and help work towards a reasonable resolution in accordance with these Terms.

Depending on the circumstances, this may include:

  • issuing a refund;
  • releasing or retaining a deposit;
  • issuing a partial refund;
  • compensating for verified damage;
  • rejecting a claim where there is insufficient evidence or basis for it.

OUTERO reserves the right to make decisions regarding the handling of payments or deposits based on the available information and applicable rules.

10. Responsibility for equipment

The owner is responsible for accurately describing the equipment they list and for ensuring that it is in a condition suitable for its intended use.

The renter is responsible for using the equipment responsibly, safely and in accordance with its intended purpose and the manufacturer's instructions.

OUTERO cannot guarantee that every item listed on the platform is suitable for a particular activity, use case or skill level.

Before using equipment, particularly safety-related or specialised equipment, the renter should independently determine whether it is suitable for the intended activity and follow all applicable safety instructions and requirements.

11. Prohibited use

Users may not use OUTERO for:

  • unlawful activities;
  • listing unlawful or dangerous items;
  • fraud or misleading other users;
  • circumventing platform payments or fees;
  • activities that could damage the platform or compromise its security.

OUTERO may restrict or terminate an account in cases of serious or repeated violations of these Terms.

12. Content

When you publish photographs, text or other information on OUTERO, you confirm that you have the right to use and publish that content.

You grant OUTERO a non-exclusive right to use that content for the operation, presentation and promotion of the platform.

13. Personal data

Personal data is processed in accordance with applicable law and OUTERO's Privacy Policy.

Please refer to the Privacy Policy for more information about what data we collect, why we use it and how we protect it.

14. Changes to the platform and these Terms

OUTERO may modify, update or temporarily suspend individual features of the platform.

If these Terms are materially changed, a new update date will be provided.

The Terms applicable to an already confirmed booking will not be changed in a way that unfairly affects obligations already accepted by the users.

15. Applicable law

These Terms are governed by applicable Bulgarian law.

Where a user has rights granted by mandatory provisions of applicable law, those rights remain unaffected by these Terms.
